TERMS OF SERVICE & PRIVACY POLICY

📄 8bit – Global Mobile App Terms & Conditions and Privacy Policy

Effective Date: 20th of August 2025

Welcome to 8bit (“8bit,” “we,” “us,” or “our”). These Terms & Conditions and Privacy Policy (“Agreement”) govern your use of the 8bit Mobile App (“App”) , the 8Bit Telegram HUB, the 8Bit Discord server and the 8Bit website worldwide.

By accessing or using the App and all other platforms listed above, you confirm you have read, understood, and agree to be bound by this Agreement.


1. Eligibility

You must:

  • Be at least 18 years old, or have parental/guardian consent if under the age of majority in your jurisdiction.

  • Be legally competent to enter into a binding contract in your country.


2. Governing Law and Jurisdiction

This Agreement is governed by the laws of England and Wales. All disputes shall be subject to the exclusive jurisdiction of the courts of London, UK.

Note: Users may also have statutory rights under their local laws (e.g., GDPR in the EU, CCPA in California) that cannot be waived. Those rights apply in addition to these Terms.


3. User Obligations

You agree:

  • To use the App lawfully and in compliance with applicable global laws.

  • Not to upload content that is defamatory, obscene, infringing, or otherwise illegal.

  • Not to attempt unauthorized access or disrupt the App.

  • To provide accurate, current, and complete information when prompted.


3.1 Conduct and Behavior

  • No foul, abusive, discriminatory, or offensive language or behavior is allowed in the App or on 8bit-managed social media channels.

  • Violations may result in immediate removal of content, suspension, or permanent bans.

  • Decisions by 8bit administrators are final and binding.


3.2 Cheating and Fraudulent Activity

Prohibited behaviors include:

  • In-game cheating, bug exploitation.

  • Creating false, duplicate, or “ghost” accounts.

  • Using bots, scripts, or automation tools.

Consequences:

  • Immediate suspension or termination.

  • Forfeiture of any points, rewards, or benefits.

  • Permanent bans at 8bit’s discretion.


4. Intellectual Property

  • All intellectual property in the App, its design, content, trademarks, software, and any future updates or new features is owned or licensed by 8bit.

  • You may not copy, reverse engineer, or create derivative works.

  • Any user-generated content you submit grants 8bit a limited, non-exclusive license to use it solely to operate and promote the App.


5. Updates and Upgrades

We may release updates and new features that add or change functionality. Continued use after updates means you accept the updated Terms.


6. Rewards and Points

  • Users may earn “Points” through daily active use (DAU) or engagement.

  • Points have no cash value and are not redeemable outside the App.

  • In the future, redemption options may be enabled, subject to new terms.

  • Updates on rewards will be posted via the App and official community channels (e.g., Discord).


7. Developer Terms

7.1 Revenue Share

Developers receive 33% of net ad revenue generated within their games.

7.2 Rewarded Ads

8bit may serve rewarded ads in developer games.

7.3 Data Access

  • Developers do not receive personal data.

  • Only aggregate metrics (MAU, ad engagement) are shared via the Developer Portal.

By submitting games, developers accept these Terms and future updates.

7.5 Separate Agreement

A detailed Developer Agreement with payout schedules will be provided via the Developer Portal.


8. Payments

  • All payments are processed securely by Stripe.

  • 8bit does not store or process credit card or bank details.

  • Payment disputes must be resolved with Stripe directly.


9. Disclaimer of Warranties

The App is provided “as is” and “as available.” We do not guarantee uninterrupted service or error-free functionality.


10. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages.

  • Total liability will not exceed the amount paid by you in the 3 months prior to a claim.


11. Indemnification

You agree to indemnify and hold 8bit harmless from claims, damages, or expenses arising from:

  • Your use of the App.

  • Your breach of this Agreement.

12. Global Compliance

We adhere to the strictest applicable standards globally, including:

  • UK & EU: General Data Protection Regulation (GDPR) and ICO oversight.

  • US: California Consumer Privacy Act (CCPA/CPRA) and relevant federal/state laws.

  • Other regions: Local privacy laws (e.g., India’s DPDP Act, 2023).

Where laws differ, we apply the strictest protections globally.


13. Data We Collect

We only collect the minimum data needed:

  • Email address (for login, support, notifications).

  • Location data (if you consent, via device prompts or IP address).

  • Device and technical data (device type, OS, IP, unique IDs).

  • Usage metrics (session duration, logins, DAU, ad views).

We do not collect names, payment details, or sensitive categories (health, biometrics).


14. Purpose of Collection

We process data to:

  • Provide and improve the App.

  • Monitor engagement and performance.

  • Deliver and measure ads.

  • Communicate service updates.

  • Comply with legal obligations.


15. Data Sharing and Disclosure

We never sell or rent personal data.

Data is shared only:

  • With service providers (hosting, analytics, ad delivery) under contract.

  • With regulators or law enforcement where legally required.

  • As part of a business transfer or merger.


16. International Data Transfers

Your data may be stored and processed in the UK, EU, US, or other regions. We ensure protection using GDPR standard contractual clauses or equivalent safeguards.


17. Data Retention

  • Data is kept as long as accounts remain active.

  • Deleted/anonymised once no longer needed or legally required.


18. Your Rights

Depending on your location, you may have the right to:

  • Access, correct, or delete data.

  • Withdraw consent.

  • Opt-out of targeted advertising.

  • Request data portability (GDPR/CPRA).

  • Lodge a complaint with a regulator (ICO, EU authority, US regulator, etc.).


19. Data Security

We use encryption, access controls, and secure infrastructure. We comply with GDPR, CCPA, and other strict frameworks globally.

21. Updates

We may update these Terms & Privacy Policy to reflect new features, legal requirements, or global changes. Significant updates will be notified via the App or email.
